The Ministry of Internal Affairs of Russia has prepared a law on the deportation of migrant workers without a contract

The document developed by the Russian agency provides for the introduction of a ban on attracting foreigners to work without concluding an employment contract. For violation of the employer can be fined, and the foreigner is also expelled from the country, the Ministry of Internal Affairs of Russia has prepared a draft amendment to the Code of Administrative Offenses, suggesting that it be supplemented with rules prohibiting the entry of foreigners to work in Russia without entering into an employment contract with them or a civil law contract for the performance of work, RBC reports.

In accordance with the draft document, the violation of this prohibition should be punished by imposing a fine on individuals up to 5 thousand rubles. On officials for the same violation can be imposed a fine of up to 50 thousand rubles. As for companies, they can be punished not only by a fine (up to 800 thousand rubles.), But also by suspension of work for up to three months.

Similarly, it is suggested to punish those who attracted foreigners and stateless persons who did not declare their intention to look for work in Russia at the time of entry into the country.

An amendment to another article provides for the imposition of fines (up to 5,000 rubles) for the foreigners who have entered into employment without entering into an employment contract. An additional punishment for violators could be administrative deportation outside of Russia.

The need to adopt a new law in the Ministry of Internal Affairs is explained by the need to improve control over the implementation of the provisions of the Treaty on the Eurasian Economic Union (EAEC). At present, the citizens of the countries that are members of the EAEC (Armenia, Belarus, Kazakhstan, Kyrgyzstan) do not need special permits to work in Russia, but for a long stay in the country, there is still an employment contract.

"The state must clearly understand with what goals foreign citizens and stateless persons come to the Russian Federation and what activities they actually carry out on its territory", — stressed in the comments of the Ministry of Internal Affairs.

The drafters of the bill emphasize that the lack of an effective mechanism for monitoring the observance of the terms of stay in Russia by foreigners who for work does not need permits, leads to "their uncontrolled and uninterrupted finding on the territory of the Russian Federation, which can negatively affect the migration and criminogenic situation in the country".

Another problem is that the uncontrolled involvement of foreigners leads to the collection of incorrect statistics on the number of migrant workers and deprives the authorities of the ability to objectively predict the migration situation.

"The conditions under which this problem can be solved without interference from the state are currently lacking", — the document says.
