WARSAW, October 1, 2009, Asia-Plus — Tajikistan ought to replace the institution of residence permit as being unconstitutional with regard to Tajik nationals, foreign citizens and stateless persons by registration upon notice, Sergey Romanov, a lawyer with the public association Bureau on Human Rights and Rule of Law (BHR) of Tajikistan, remarked at the OSCE Human Dimension Implementation Meeting in Warsaw on September 30.
He read the paper at the conference on problems of free movement of stateless persons living in Tajikistan.
The institution of residence permit is the legacy of the Soviet era and violates the right of human being for free movement within the country provided for by the Constitution of the Republic of Tajikistan and Article 12 of the International Pact on Civil and Political Rights, Tajik human rights activist said, noting that foreign citizens and stateless persons do hove the right to purchase dwelling houses in Tajikistan.
Romanov also proposes to abolish the institution of exit visa both for Tajikistan and other countries, where such a practice still exits. This institution also violates the right of human being for free movement, he said.
Besides, the BHR lawyer considers that Tajikistan should bring its national legislation concerning administrative exclusion into compliance with international standards.
