President Emomali Rahmon has introduced a number of staff changes to the country’s judicial system dismissing a number of judges, according to the Tajik president’s official website.
By president’s decree Izatullo Tabarzoda was relieved of the post of deputy chairperson of the Khatlon regional court for age reasons.
By president’s decrees judges at the Dushanbe city court Muhammadali Yusufzoda and Abdumone Abdulghanizoda were retired in connection with the achievement of the age limit for tenure as a judge.
Meanwhile, the judge at the Panj district court in Khatlon province, Saidahmad Zaidullozod was dismissed for committing an act discrediting the honor and dignity of a judge, said the Tajik president’s official website.
A report released by the International Commission of Jurists (ICJ) in December 2020, in particular, noted that the judiciary in Tajikistan is still not fully independent owing, inter alia, to the role of and influence exerted by the executive and legislative branches
According to the Constitution of Tajikistan, “the judicial power being independent, is exercised on behalf of the State only by judges. The judiciary protects the rights and freedoms of a person and a citizen, the interests of the State, organizations, institutions, legality and justice.”
The Tajikistan judiciary has three types of court with differing jurisdictional competencies: 1) general courts; 2) economic courts; and 3) the Constitutional Court.
The courts of general jurisdiction, including specialized military courts, consider the largest variety of cases, including, civil, criminal, family, labor, military and other cases. Courts of economic jurisdiction consider commercial disputes, and cases related to business and other commercial activities. The Constitutional Court considers constitutional matters regarding compliance of laws with the Constitution of Tajikistan.
