57 cases of violation of constitutional regulations recorded over the past three years, says SDPT leader

DUSHANBE, March 19, Asia-Plus  — “Over the past three years, 57 cases of violation of the constitutional regulations have been recorded in Tajikistan,” Rahmatillo Zoirov, the leader of the Social-Democratic Party (SDPT) also the head of the Tajik Legal Consortium, said in an interview with Asia-Plus yesterday after a press conference hosted by the SDPT on occasion of the 10th anniversary of the foundation of the party.  

According to him, the situation when regulations of the country’s basic law are violated can be assessed as “constitutional nihilism.”

 “I am seriously concerned over the fact that the Constitutional Court keeps silent,” said Mr. Zoirov.  “It is a pity that the Constitutional Court head participating at sessions of the upper house of the parliament becomes tacit witness to violation of the Constitution.” 

According to him, the other problem is the fact that the Constitutional Court in Tajikistan does not have the right of interpretation of laws.  

In the meantime, Asia-Plus’ reporter recently applied to the Constitutional Court asking to give its assessment to the upper house’s resolution on transferring six GBAO’s villages to the Tavildara district, which subordinates to the center, without coordinating the issue with the GBAO regional legislature.  In his official reply to our application, the Constitutional Court Izbullo Khojayev said, “You are not a party having the right to file application to the Constitutional Court.”       

Commenting on this case, Rahmatillo Zoirov stressed that in this case, the court cared for formality rather than the fact of the matter.
