TSUM administration to appeal court decision

DUSHANBE, February 9, 2011, Asia-Plus  — Administration of joint-stock company (JSC) Furushgohi Markazi (central department store) intends to appeal ruling handed down by Dushanbe Economic Court.

The Furushgohi Markazi director general Boymurod Kholmurodov told Asia-Plus today that they will appeal to Higher Economic Court of Tajikistan.  “We do not agree with the decision of Dushanbe Economic Court, but we are not going to organize rally,” said Kholmurodov, “We will act in accordance with law.”

We will recall that operations of the Central Department Store (TSUM), which is one of Dushanbe’s oldest stores, have been suspended following the ruling handed down by the Dushanbe Economic Court.  TSUM was sealed Tuesday morning.  The Dushanbe central department store (TSUM) is said to have been suspended due to internal contradictions.  Judge Farrukh Khojayev from the Dushanbe Economic Court who has handed down ruling on suspending the TSUM operations has refrained from commenting on the case.

According to Kholmurodov, the internal contradictions began in early 2007 already, when the Furushgohi Markazi board made a decision to shift from the commission contract to the real agreement.

“Head of one of departments of the company, Abdullo Odinayev, refused to pay rental fee because he is one of shareholders of Furushgohi Markazi,” said the director general, “He did not want to realize that he is not the owner but just one of shareholders like 85 percent of merchants running their sales outlets at the department store.  Odinayev has repeatedly filed lawsuits in economic courts of different instances.  In late 2009, he applied to Higher Economic Court over this subject but Higher Economic Court did not sustain his claim.”  In October 2010, Odinayev applied to the board of appeals of the Dushanbe Economic Court and it answered to his claim for some obscure reason, Kholmurodov said.

He noted that more than 1 million somoni worth of goods have been amassed in the store and the store would lose up to 17,000 somoni per month.  More than 200 people now work with Furushgohi Markazi.
