DUSHANBE, August 4, 2010, Asia-Plus — Economic entities that have failed to reregister will be punished in accordance with the provisions of the country’s criminal and administrative codes, Asia-Plus has learned from the source at the Tax Committee.
“Under Article 671 of the administrative code, those who have failed to reregister should pay a fee in amount equal to up to 10 accounting indicators for physical entities, up to 40 accounting indicators for officials, and up to 250 accounting indicators for legal entities (the accounting indicator for this year is set at 35.00 somoni – Asia-Plus),” said the source, “Only after paying fees they can apply for re-registration and continue their operations.”
He added that if during the period from July 1 to August 1 this year economic entities that failed to re-register earned revenue in an amount of more than 1,000 accounting indicators (equivalent to 35,000 somoni), this would be considered illegal entrepreneurial activity. Article 259 (1) of the Tajik Penal Code stipulates that illegal entrepreneurial activity is punishable by payment of fees in an amount from 500 to 1,000 accounting indicators or by up to three years in jail. “Under Part 2 of this article, the same actions committed by an organized group and associated with gaining large profit from those actions are punishable by payment of fees in an amount of 1,000 to 2,000 accounting indicators or by up to five years in jail,” the source said.
We will recall that according to the data provided by the Tax Committee, only 40 percent of legal entities and individual entrepreneurs operating in the country have been reregistered by July 1 this year. As of July 1, 2010, 87,700 economic entities have failed to reregister. In all, 57,664 economic entities, including 12,900 legal entities and 44,700 individual entrepreneurs, have been reregistered by the Tax Committee by July 1, 2010.
