DUSHANBE, December 17, Asia-Plus  — The RT Law “About the Third Party Arbitration Courts” was passed on December 12, 2007 by the Majlisi Namoyandagon (Tajikistan’s lower chamber of parliament) due to substantial contribution of Interagency Working Group and Public Foundation “Arbitrazh”, Nigora Astanova, public relations coordinator, Public Foundation Arbitrazh, said, .

The necessity of the Law “About the arbitration Courts” is connected with the implementation of the program of judicial reform and strengthening the rights and freedoms of citizens, judicial validity and the rule of law in Tajikistan.

Other aspects of the adoption of the law are the legislative formulation of the activity of arbitration courts and the expansion of the practice of the disputes consideration, which arise in the society in connection with the social problems and their solutions on the basis of impartial mediation and arbitration.

New law exhorts to play important role in training of the arbitrators, increase the status of arbitration courts and their authority among the population.

As a whole this legislative act will become serious step in the direction of the guaranteeing of human rights and freedoms, use of the perfect methods of solving the civil disputes, connected with the social and economic problems – housing, property, lease of the earth and credits, and also the construction of civil society in Tajikistan.

  The Public Foundation for the development of third party arbitration courts and legal support centers Arbitrazh is organized on a local, national and international level to address issues in support of the public good.  The Public Foundation Arbitrazh was registered with the Ministry of Justice (MoJ) on November 14, 2005. Currently the “Arbitrazh” Public Foundation is implementing the “Support to the Development of Third Party Arbitration Courts (TPAC) Project” in Tajikistan, funded by The Department for International Development (DFID), the UK Government department responsible for promoting sustainable development to improve livelihoods
