December 7, 2011, Asia-Plus – At the third session of the Majlisi Namoyandagon of the fourth convocation of Majlisi Oli of Tajikistan on Wednesday, December 7, the deputies approved amendments to the Labor Code of the Republic of Tajikistan, proposed by colleagues Nazir Gafarov, Sabohat Mukumova and Merojiddin Hakimov.

In her speech on this issue one of the initiators of the amendments, the deputy Sabohat Mukumova noted that according to the additions to the Labour Code, henceforth employers in Tajikistan, regardless of their ownership, are prohibited to employ citizens without a written employment contract for a period of one year.

“Today our country is practiced hiring for one, two, three months and without a written contract, which leads to the violation of civil rights, in particular, to leave, welfare payments, to pay for sick leave”, – noted Mukumova.

According to the Minister of Labour and Social Protection of Tajikistan Mahmadamin Mahmadaminov, who made a speech on the above mentioned issue before the deputies, at this moment there are about 2 million people were provided with jobs, of which over 50 percent are women.

“Basically, the majority of working people in the private sector have a problem with getting holidays, dismissal from work without explanation, but after the adoption of amendments to the LC within a year no one has the right to dismiss workers without holding the appropriate certification or on the conclusion of the medical commission” – said the Minister.

Deputy Shodi Shabdolov in his speech noted that on the issue of dismissal of citizens, the leaders not only of private companies but also government agencies abused their authority. “Today, no one in Tajikistan did not know how to be paid the overtime of working hours of workers, how is appreciated their work on weekends or holidays” – asked the deputy.

The author of amendments replied the leader of the CPT that the Labour Code of the country defines the payment for overtime working hours, work on weekends or holidays at double rate.
