Kabiri’s lawyer vows to appeal to UN Human Rights Committee

DUSHANBE, June 4, 2013, Asia-Plus – Buzurgmehr Yorov, the defense lawyer of Muhididn Kabiri, member of Tajikistan’s lower house (Majlisi Namoyandagon) of parliament, is waiting for reply to his appeal filed in the Dushanbe city court against the ruling handed down by a court in Dushanbe’s Sino district.

We will recall that the court in Dushanbe’s Sino district considered a lawsuit filed by the Dushanbe mayor’s office against MP Muhiddin Kabiri, who is also leader of the Islamic Revival Party (IRP), on January 29 and ruled Muhiddin Kabiri must apologize to the mayor’s office.  Besides, the court has thrown out a counterclaim by Muhiddin Kabiri against the Dushanbe mayor’s office for 20 million somoni in damages.

Kabiri’s lawyer denounced the ruling handed down by the Sino district court and appealed to Dushanbe city court on February 7.

According to Yorov, if the Dushanbe city court upholds the ruling handed down by the Sino district court, he will appeal to the Supreme Court.

“If the Tajik judicial instances do not solve this issue, we will appeal to the United Nations Human Rights Committee,” Yorov told Asia-Plus in an interview.

Some local experts note that the case pitting the Dushanbe mayor’s office against Muhiddin Kabiri has given an opportunity to see to what an extent Tajik judicial bodies are really independent     

As it had been reported earlier, speaking at an October 10 sitting of the Majlisi Namoyandagon, MP Kabiri raised the issue of cutting down trees in the capital city.  Kabiri noted that practically nobody paid attention to the problem of cutting down trees in Dushanbe that is affecting the ecosystem in the city.  “Reinforced concrete buildings are being constructed in places of alleys and public gardens in Dushanbe,” the parliamentarian noted.

The Dushanbe mayor’s did not agree with criticism of the parliamentarian and demanded public apology.

For his part, Muhiddin Kabiri filed a lawsuit against the Dushanbe mayor’s office asking for 20 million somoni in damages.
