Russian President Vladimir Putin has signed a decree requiring foreign nationals unlawfully residing in Russia to either regularize their legal status or leave the country by April 30, 2025.  Exceptions apply to individuals who have entered into military service contracts.

 

Key provisions of the decree

From January 1 to April 30, 2025, foreign nationals and stateless persons listed in the registry of controlled persons can regularize their legal status in Russia.  According to the decree, this process does not require leaving the country or adhering to the stated purpose of entry.

As of October 2024, over 120,000 Tajik nationals are included in Russia’s registry of controlled persons. This registry includes individuals with expired or annulled migration documents, as well as those who have committed administrative offenses and are subject to deportation.

The procedure will follow Federal Law No. 115 "On the Legal Status of Foreign Nationals in the Russian Federation," incorporating the specifics outlined in the new decree.

 

Exceptions for foreigners required to leave Russia

The decree provides exceptions for foreign nationals wishing to regularize their legal status under certain conditions:

Submission of biometric data — Foreigners must provide biometric data or undergo identification according to Russian legislation.

Medical examination — Foreign nationals must undergo a medical examination for the presence of narcotics, psychoactive substances, and infectious diseases, including HIV. The examination must be conducted within one year before the application is submitted.

Proof of knowledge — Foreigners must present documentation confirming proficiency in the Russian language, knowledge of Russian history, and an understanding of Russian laws.

Voluntary debt settlement — Foreigners must voluntarily settle all outstanding debts as per Russian law.

No grounds for denial — There must be no legal grounds for denial or annulment of work permits, residency, or visas.

 

How to extend temporary stay

Foreign nationals who regularize their status can work in Russia without a patent or work permit.  To extend their stay, they must apply to the Ministry of Internal Affairs.  Applications can be submitted directly or via authorized organizations.

In Moscow, applications are also accepted through organizations designated by local authorities. The application must include a copy of an employment or civil contract, certified by the employer or service provider.

If a foreigner lacks a migration card, a duplicate will be issued according to Russian law.

 

Exemption for foreign military personnel

The requirement to leave Russia does not apply to foreign nationals who have signed contracts for military service.  Deportation decisions and entry bans are lifted for these individuals unless they pose a security threat, support terrorism or extremism, or are involved in violence or illegal activities.
