The Government of Tajikistan has approved a draft law amending the Air Code and sent it to the Majlisi Namoyandagon (Tajikistan’s lower chamber of parliament) for review. The relevant decree was published on the Ministry of Justice’s legal information portal.
The main goal of the extensive amendments is to expand the regulation of civil aviation and strengthen the flight safety control system. The draft law introduces dozens of new terms related to the activities of airlines, aviation training and medical centers, air navigation, ground services, and the use of airspace, including unmanned aerial vehicle (UAV) operations.
Key changes include clarifications of definitions such as "passenger," "landing area," and the status of aircraft in distress or already in trouble. New requirements are also introduced for airports and airport territories.
Special attention is given to state control and oversight of civil and experimental aviation activities. The draft law outlines a clear list of activities subject to oversight, including aircraft operation, air traffic control, technical maintenance, medical inspections of personnel, and ensuring aviation and information security.
A separate section defines the role of aviation inspectors, granting them expanded authority to access aircraft and infrastructure facilities. Inspectors will be authorized to issue mandatory instructions, suspend flights, and ensure compliance with certification requirements. The draft also sets qualifications, training, and insurance requirements for inspectors while performing their duties.
Significant updates are included regarding the investigation of aviation incidents and accidents. The draft law proposes creating a unified system for mandatory and voluntary reporting of aviation events, ensuring the protection of information sources and the independence of investigative commissions. It also outlines procedures for cooperation with foreign countries and the International Civil Aviation Organization (ICAO).
Furthermore, the draft law clarifies rules for medical examinations of aviation personnel, certification of aviation medical centers and experts, as well as the certification process for aircraft types and the recognition of foreign certificates. It also updates the norms for the registration and de-registration of aircraft from the State Register.
