DUSHANBE, September 25, 2008, Asia-Plus  — The presentation on “Construction Business, Legislation and Reforms” was held in the conference hall of the State Committee for Investments and State-owned Property Management in Dushanbe on September 24.

According to press release issued by the US Embassy in Dushanbe, the presentation was organized by State Committee on Investments and State Property Management of the Republic of Tajikistan with the technical support of the USAID Business Environment Improvement (BEI) Project.  The goal of this presentation was to familiarize relevant stakeholders with current legislation in the field of construction, the experience of some other countries, as well as provide practical recommendations for improving permit and licensing systems in the field of construction.

Construction is one of the most important areas of the economy of any nation. The importance of the construction industry is not only its direct influence on the development of the economy, but also in its indirect impact on social and cultural development of the country, particularly people”s standard of living. As one of the major industries, construction requires special attention from the government.

In addition, construction is potentially a dangerous activity, and the violation of the mandatory requirements can lead to severe, irreversible consequences, affecting the health and lives of people and resulting in extensive material damage. In this regard, the State has a duty and responsibility for creating the necessary conditions, including investment climate, for the development of the construction industry, and for regulating the safety of both ongoing construction operations and facilities through enforcing various regulations and rules.

The regulation of the construction industry needs to be reflected in laws that consolidate all relationships across the full spectrum of construction activities – from the conceptual vision of the development of the industry to detailed regulation of all processes of construction. With the changes in the current economic conditions and relations, the development of the sector, including those related to construction, the rules governing the construction process must be amended and updated.

In order to identify gaps and inconsistencies which create obstacles in the functioning of the construction industry and highlight the legal problems encountered during construction process, the USAID Business Environment Improvement project (BEI) in cooperation with interested stakeholders presented an analysis of the legislation in the field of construction in Tajikistan.  The representatives of Government, ministries and institutions, members of the construction process, as well as representatives from the private sector took part in that presentation.

The USAID BEI Project is one of the many assistance projects made by the American people through the United States Agency for International Development (USAID).  Since 1993, the American people through USAID have provided about 300 million USD in programs that support democratic institutions, the social sector and economic growth in Tajikistan.
