As a result of torture, he confessed to a crime he did not commit, and then the policemen released him because they caught real criminal.

The General Prosecutor's Office of Tajikistan canceled the decision to refuse to open a criminal case on the application of torture of a resident of Yavan Shahboz Akhmadov. Supervisory authority ordered the prosecutor's office of Javan to conduct additional verification of the arguments of the local resident.

Resident of Yavan Shahboz Akhmadov on July 31, 2018 applied to the Legal Assistance Group of the Coalition of Civil Society Against Torture and Impunity in Tajikistan for help.

According to him, from July 16 to 20, 2018, he was illegally detained in the Ministry of Internal Affairs of the city of Yavan, where he was tortured and ill-treated.

«He claimed that he was beaten and tortured with electric shocks. According to him, unable to withstand the severe physical pain, admitted that he deliberately hit a man with a knife and caused him severe bodily harm», – the Coalition notes

However, on July 20 he was released home, since the identity of the person suspected of committing this crime was established.

«The victim, who was in the hospital, also did not identify the attacker in Akhmadov. Thus, Shahboz Akhmadov was not guilty of committing a crime in which he "frankly confessed", the Coalition notes.

The expert of the interdistrict department of forensic medical examination in the districts of Jami, Khuroson and Yavan, where Akhmadov addressed, concluded that Akhmadov's body showed injuries in the form of abrasions, the nature and properties of which indicate that they were obtained under the influence of blunt and hard objects.

On August 6, 2018, the Prosecutor's Office of the city of Javan began a pre-investigation check on the application of the lawyer about the unlawful actions of police officers of the Ministry of Internal Affairs of Yavan against Akhmadov. According to the results of the inspection, a decision was made to refuse to open a criminal case due to the fact that in the actions of the police there was no evidence of a crime.

The lawyer sent a request to a higher authority, as a result of which, on August 17, 2018, the Prosecutor General's Office demanded the materials of the case and, having studied them, canceled the decision to refuse to open a criminal case with the wording "in connection with the illegality and haste of acceptance".

The case is again sent for further investigation to the prosecutor's office of Khatlon region. The Coalition plans, in cooperation with a lawyer, to provide all the arguments and evidence in order to punish the perpetrators of torture.
