Leader of SDPT urges Tajik Education Minister to cancel his unlawful decision

Rahmatillo Zoirov, chairman of the Social Democratic Party of Tajikistan, made a statement regarding the decision of the Minister of Education to start classes in schools and universities on September 1. According to Zoirov, this is a direct violation of the law. He calls on the Minister of Education to comply with the laws and go out with a request to postpone the day of Idi Qurbon for another day or to cancel his illegal decision.

"In recent years, in Tajikistan more and more intrusive in government policy is a vicious departmental practice on emasculating the concepts of legality and the rule of law and the departmental decisions of individual ministries are in violation of the letter and spirit of the laws and interests of citizens, while this is done for the benefit and interests of the citizens, the entire population of the country ", – said in a statement Rahmatillo Zoyirov, chairman of the SDPT, which he posted on Facebook.

As noted by Zoirov, a few days ago, the relevant authorized bodies in Tajikistan announced that in 2017 Idi Qurbon will be celebrated on September 1. "Is this a thought-out decision or not?- remains on the conscience of officials and authorized bodies, but the decision is made – so please follow the law because Idi Qurbon, in accordance with the Law of the Republic of Tajikistan on holidays and the Labor Code, such as Idi Ramazon, is fixed in the country's legislation as a holiday, with corresponding consequences", – Zoirov approves.

"Therefore, a typical example of legal incompetence (or legal nihilism) is presented by the Ministry of Education of the Republic of Tajikistan, which on August 25 makes a decision according to which on September 1 in all educational institutions of the country this day is declared a school day. What's this? This is a direct violation and disregard for the law on holidays the rights of citizens to rest and freedom of conscience in accordance with the law.  The question is, where did the Ministry of Education look when it was decided to announce the day of Idi Qurbon on September 1? If the Ministry of Education, in accordance with its appointment and tradition, had to hold the Day of Knowledge on September 1, then they first had to agree with the bodies authorized by that body to postpone Idi Qurbon's for another day, and not to take an obviously unlawful decision", – Zoirov notes.

According to lawyer Zoirov, there are only two ways of observing and enforcing the law: either to postide Idi Qurbon on another day, or to cancel its decision, which is illegal and violates the rights of citizens.

"As chairman of the SDPT and a lawyer, I call on the Ministry of Education and the Minister to observe and enforce the laws of the republic, and immediately go out with a request to postpone the day of Idi Qurbon for another day, or cancel his unlawful decision. Laws are adopted for compliance and enforcement, and not direct violation, especially from the Ministry of Education!", – Rahmatillo Zoirov says.
