DUSHANBE, September 7, 2011, Asia-Plus  — Trial of three residents of Qurghon Teppa, found guilty of theft, has been finished but it has turned out that the preliminary investigation of that case was conducted by local police with violation of law.  Therefore, court has imposed administrative action on Mehrob Toshev, an investigator with the Khatlon police directorate.

Sharif Hayotov, the lawyer of one of defendants, told Asia-Plus today that the investigator had seriously violated norms of the criminal procedure law while investigating the case.

According to him, the investigator pinned the crime (theft) on his client Saidmubilkhon Jamolov and his two accomplices, which they had not committed.

Saidmubilkhon Jamolov has told a court police officers beat him during the preliminary investigation and forced him to confess to the crime he did not commit.

During the trial, the prosecution failed to produce evidence supporting the charge brought against Jamolov under the provisions of Article 244 (3) of Tajikistan’s Penal Code and that charge against him was dropped.

Meanwhile, the court found Saidmubilkhon Jamolov and two his accomplices, Suhrobiddin Qayumov and Nourali Sattorov, guilty of theft under the provisions of Article 244 (2) and sentenced them to three years in prison.  The defendants were released in the courtroom under an amnesty.
